What You Need to Know About the Shortened OP&F Evidence Submission Deadline

Zamora & Hogan Co., L.P.A. is dedicated to keeping you updated on the latest changes that could affect your legal rights and benefits. A notable change has occurred regarding the Ohio Police & Fire Pension Fund (OP&F). Changes have been made regarding the evidence submission deadline for disability retirement appeals, which has been shortened by 50%.

Key Changes to OP&F Evidence Submission and What They Mean for You

As we navigate the recent changes proposed by the Ohio Police & Fire Pension Fund (OP&F), it's crucial to understand what these updates mean for you and your disability retirement appeal.

Here are the key points:

  • Reduction in evidence submission deadline: The current regulations allow a member 90 days to file an appeal after receiving the OP&F's decision on their disability retirement application. After filing the appeal, members have an additional 60 days to submit supporting evidence. However, under the new rule (Ohio Adm. Code 742-3-05(E)(3)), this 60-day timeframe will be cut down to just 30 days. This means members will have only half the time they currently do to submit their supporting medical or psychological evidence.
  • Option for deadline extension: Despite the shortened deadline, members can still request an extension. The request must be made before the initial 30-day deadline expires, and the member must demonstrate a "good cause" for needing the extension.
  • Effective Date Set: The effective date of this amendment is 4/21/2024.

These changes could have significant implications for your disability retirement appeal process. It's vital to stay informed and prepared. If you have any questions or concerns about these changes, don't hesitate to contact us. We're here to help.
